GTC

1. Scope

These General Terms and Conditions (GTC) govern the contractual relationships between MMDSTORE (hereinafter referred to as “Seller”) and its customers (hereinafter referred to as “Buyer”) for all contracts concluded through the Seller’s online shop.

2. Conclusion of Contract

The presentation of products in the Seller’s online shop does not constitute a legally binding offer but merely an invitation for the Buyer to submit an offer. By placing an order in the online shop, the Buyer submits a binding offer to conclude a purchase contract. The contract is formed as soon as the Seller confirms the Buyer’s order in writing (via email) or ships the goods.

3. Right of Withdrawal

The Buyer has the right to withdraw from the contract within 14 days without stating any reason. The withdrawal period begins on the day the Buyer receives the goods. The Buyer bears the cost of returning the goods. The right of withdrawal does not apply to: goods made according to customer specifications or clearly tailored to personal needs (e.g., personalized leather or textile products); sealed items that are not suitable for return due to health protection or hygiene reasons once the seal has been removed after delivery; audio or video recordings or computer software in sealed packaging after the seal has been removed; newspapers, magazines, or illustrated publications (except subscription contracts); goods that can spoil quickly or whose expiration date would be exceeded rapidly.

4. Prices and Shipping Costs

All prices are in Swiss francs (CHF) and include statutory value-added tax. Shipping costs are displayed to the Buyer during the ordering process and must be paid by the Buyer unless otherwise indicated.

5. Delivery

Delivery is made to the address provided by the Buyer during the ordering process. Delivery times are stated in the online shop and are for reference only. The Seller is not responsible for delays caused by third parties (e.g., shipping service providers). The Seller is entitled to make partial deliveries, provided these are reasonable for the Buyer.

6. Payment Terms

The purchase price is due immediately and without deduction. The Buyer may choose from the payment methods offered in the online shop.

7. Warranty

A statutory warranty period of two years applies for material and workmanship defects. The Buyer must report obvious defects in writing (via email) within 14 days of receiving the goods. In the event of a warranty claim, the Seller has the right to repair the goods or replace them with equivalent goods.

8. Liability

The Seller is liable only for damages resulting from intentional or grossly negligent breach of duty. Liability for slight negligence is excluded unless the damages involve life, body, or health.

9. Data Protection

The Seller’s privacy policy applies and can be viewed on the Seller’s website (www.mmdstore.ch/datenschutz).

10. Applicable Law and Place of Jurisdiction

Swiss law applies, excluding conflict-of-law rules. The place of jurisdiction for all disputes arising from or related to these GTC is Zurich.

11. Final Provisions

If individual provisions of these GTC are or become invalid, the validity of the remaining provisions shall remain unaffected. The Seller reserves the right to amend these GTC at any time. The current version of the GTC can be viewed on the Seller’s website.
